After ineffective lapse of the indicated time, the complaint is left unexamined.
  3. Submission of a complaint by a Consumer, as well as its rejection or leaving it unexamined by the Seller, does not affect the Consumer’s right to pursue claims through court proceedings in accordance with applicable law.

  2. a) are suitable for the purposes for which goods of that type are normally used, taking into account applicable legal provisions, technical standards or good practices;
  1. b) are in such quantity and have such features as are typical for goods of that type and which the Consumer may reasonably expect, taking into account the nature of the goods and public assurances made by the entrepreneur, their legal predecessors or persons acting on their behalf, in particular in advertising or on the label, unless:
  • the Seller did not know about a given public assurance and, acting reasonably, could not have known about it;
  • before conclusion of the Sales Agreement the public assurance was corrected under the conditions and in the form in which it was made or in a comparable manner;
  • the public assurance did not influence the Consumer’s decision to conclude the Sales Agreement;

  1. The Seller is not liable for lack of conformity of the Goods with the Sales Agreement if the Consumer was expressly informed that a specific feature of the Goods deviates from the requirements of conformity with the agreement and, at the latest at the moment of concluding the Sales Agreement, the Consumer expressly and separately accepted the lack of this feature.
  1. The Seller is liable for lack of conformity of the Goods with the Sales Agreement existing at the time of delivery and revealed within two years from that time. It is presumed that lack of conformity revealed before the expiry of two years from delivery existed at the time of delivery, unless proven otherwise or unless this presumption cannot be reconciled with the specificity of the Goods or the nature of the lack of conformity.
  1. In the event of lack of conformity of the Goods with the Sales Agreement, a Customer who is a Consumer may request repair or replacement.
  1. The Seller may replace the Goods when the Consumer requests repair, or repair the Goods when the Consumer requests replacement, if bringing the Goods into conformity in the manner chosen by the Consumer is impossible or would require excessive costs for the Seller. If both repair and replacement are impossible or would require excessive costs, the Seller may refuse to bring the Goods into conformity with the Sales Agreement.
  1. The Seller will carry out repair or replacement within a reasonable time from the moment the Consumer informed the Seller about the lack of conformity, and without undue inconvenience to the Consumer, taking into account the specificity of the Goods and the purpose for which they were purchased. The costs of repair or replacement are borne by the Seller.
  1. The Consumer is obliged to make the complained-about Goods available for repair or replacement at the Seller’s expense. The Consumer is not obliged to pay for normal use of the Goods that were subsequently replaced.

  1. c) the lack of conformity is significant enough to justify an immediate price reduction or withdrawal from the Sales Agreement;
  1. d) the Seller’s statement or the circumstances clearly indicate that the Seller will not bring the Goods into conformity within a reasonable time or without undue inconvenience to the Consumer.
  1. The reduced price should remain in such proportion to the price of the Goods as the value of the Goods not in conformity remains to the value of conforming Goods.

12. The Seller will refund the Consumer the amount due as a result of exercising the right to a price reduction promptly, no later than within 14 days from the date of receiving the Consumer’s statement on the price reduction.

13. The Consumer may not withdraw from the Sales Agreement if the lack of conformity is insignificant. However, it is presumed that the lack of conformity is significant.

14. The Consumer’s right to withdraw from the Sales Agreement is limited to Goods not in conformity with the Sales Agreement, and not to the entire order. In the event of withdrawal from the Sales Agreement, the Consumer referred to above is obliged to return the Goods to the Seller promptly at the Consumer’s expense – if return of the Goods applies.

  1. The Seller is obliged to refund the Consumer the Price promptly, but no later than within 14 days from the date of receiving the Goods back or from the moment the Seller is informed about the circumstances.

  • they do not occur in such quantity and do not have such features, including functionality, compatibility, availability, continuity and security, as are typical for Digital Content or Digital services of that type and which the Consumer may reasonably expect, taking into account the nature of the Digital Content or Digital services and public assurances made by the entrepreneur, their legal predecessors or persons acting on their behalf, in particular in advertising or on the label, unless the entrepreneur proves that:

– they did not know about the given public assurance and, acting reasonably, could not have known about it;

– before concluding the agreement for the provision of Digital Content or Digital services, the public assurance was corrected under the conditions and in the form in which it was made or in a comparable manner;

– the public assurance did not influence the Consumer’s decision to conclude the agreement for the provision of Digital Content or Digital services;

  • they are not delivered with accessories and instructions which the Consumer may reasonably expect to receive;
  • they are not consistent with the trial version or preview that was made available to the Consumer by the entrepreneur before concluding the agreement for the provision of Digital Content or Digital services.
  1. The Seller brings the complained-about digital content or digital service into conformity with the agreement for the provision of Digital Content or Digital services within a reasonable time from the moment it is informed of the circumstances, without undue inconvenience to the Customer, taking into account the nature and purpose for which the digital content or digital services are used.

  • the Seller’s statement or the circumstances clearly indicate that the Seller will not bring the digital content or digital services into conformity with the agreement within a reasonable time or without undue inconvenience to the Customer.
  1. The Seller is not liable if the Customer’s digital environment is not compatible with the technical requirements.

The Consumer is liable for any reduction in value of the item resulting from using it in a manner beyond what is necessary to establish the nature, characteristics and functioning of the item. 8. The right to withdraw from the Sales Agreement does not apply to Goods not recorded on a tangible medium if performance began with the Consumer’s express consent before the expiry of the withdrawal period and after the Consumer was informed by the Seller about the loss of the right to withdraw from the agreement for the supply of digital content or digital services.
